TrophyGolfer LLC, (“TrophyGolfer”) is aware of your care and concern as to how your personal information is used and shared, and we take your privacy seriously. Note that some Anonymous Information could be Personal Information by your actions: for example, if you choose to use your real name as your user name. Therefore, you should exercise caution when conduction and/or providing the following information. Furthermore, TrophyGolfer will not be held liable, and you expressly waive any such liability, should you use any information that could be considered Personal Information in conjunction with any of the proceeding.

BY REGISTERING AN ACCOUNT ON TROPHYGOLFER.COM OR USING ITS APPLICATIONS, FEATURES OR CONTENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND TO ALL THE TERMS OF THIS PRIVACY POLICY AND OUR WEBSITE TERMS OF USE, AND EXPRESSLY CONSENT TO USE OF YOUR INFORMATION IN ACCORDANCE WITH ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, EXIT THIS PAGE AND DO NOT ACCESS OR USE OUR WEBSITE. Your Personal Information may be processed and stored in jurisdictions where laws regarding processing of Personal Information may be less stringent than the laws of your domicile. Your Personal Information will not, however, be used or disclosed for purposes for which you have not given consent or which are not permitted under applicable law.
  • 2. Modifications. TrophyGolfer may modify this Policy from time-to-time, and will maintain an updated policy on its website. We will notify registered users of material changes to our policy. Maintaining an account on TrophyGolfer.com after such notice shall be deemed consent to any such material changes; making a purchase on TrophyGolfer shall be deemed agreement to the then-current Privacy Policy.
  • 3. Minors and Capacity to Contract. We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our website, products and services are all directed to people who are at least 13 years old or older. Children under the age of 13 are not permitted to use TrophyGolfer and we do not intentionally collect or maintain Personal Information from those who are under 13 years old. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE TrophyGolfer SERVICES AT ANY TIME OR IN ANY MANNER. If we obtain actual knowledge that a user is under 13, we will remove that user's account and Personal Information permanently from our databases. By using TrophyGolfer, you are representing that you are at least 18 years old, or that you are at least 13 years old and have a parent’s or guardian’s permission to use TrophyGolfer and the consent of the parent or guardian to provide any payments made or enter into any agreements regarding the purchase of TrophyGolfer offerings. If you are a parent or guardian and discover that your child under the age of 13 has obtained a TrophyGolfer Services account, then you may alert TrophyGolfer privacy@trophygolfer.com and request that TrophyGolfer delete that child's personal information from our systems.
  • 4. Collection of Information. In order to deliver a personal site experience to you, we collect Personal Information that you submit to us voluntarily through TrophyGolfer. Typically, this information, such as your name, valid email address and password of your choice, is provided by you in the process of creating or editing your account and user profile on TrophyGolfer. We may maintain a database of your account information, including information required to identify your account and other demographic, personal, experiential or editorial information you choose to submit. We may also collect information about you and your friends who use TrophyGolfer, from any social network you may have linked to or used as your TrophyGolfer account, in order to provide you with a more personalized experience. In most cases your TrophyGolfer Service activity is broadcast to the wider TrophyGolfer community, by default privacy settings (e.g. showing your name in the ‘who’s here’ list after someone checks in to a given place). You may choose to prevent TrophyGolfer Users outside of your “buddies” from viewing your TrophyGolfer activity. This can be done in your ‘edit profile’ section on the TrophyGolfer website. TrophyGolfer Course Operators will continuously see user activity. For instance, we may collect your user ID or profile information that you have permitted to be displayed through TrophyGolfer in order to display you as a friend or in association with your profile and collections via Facebook Connect, Twitter or any other social network or OpenID account you choose to meld with your TrophyGolfer account. We may reflect your TrophyGolfer activity back to your social network. If you wish to disassociate a third-party account with your TrophyGolfer account, you may be required to change the privacy or application settings of your social network or OpenID account to unlink that account with your TrophyGolfer account. When you make a purchase from TrophyGolfer, you will need to submit your credit card or other payment information so that our service providers can process your payment for the Deal. When you enter any contests, sweepstakes, or other activities that we make available on TrophyGolfer, we will collect the information designated along with such activity, which may include your contact information such as your address and phone number. If you choose to sign up to receive information about products or services that may be of interest to you, we will collect your email address and other related information. We collect any information that you voluntarily enter, including Personal Information, into any postings, comments, or forums within the TrophyGolfer community. Additionally, we may receive Personal Information about you from other sources with which you have registered, companies with whom we have partnered or other third parties. We may associate this information with the other Personal Information we have collected about you.
  • 5. California Residents. California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (the “Act”) and the California Business and Professions Code. As required by the Act, we will provide you with the categories of Personally Identifiable Information that we collect through the Website and the categories of third party persons or entities with whom such Personally Identifiable Information may be shared for direct marketing purposes at your request. California law requires us to inform you, at your request, (1) the categories of Personally Identifiable Information we collect and what third parties we share that information with; (2) the names and addresses of those third parties; and (3) examples of the products marketed by those companies. The Act further requires us to allow you to control who you do not want us to share that information with. To obtain this information, please send a request by email or standard mail to the address found below. When contacting us, please indicate your name, address, email address, and what Personally Identifiable Information you do not want us to share with Affiliated Businesses or Marketing Partners. The request should be sent to the attention of our legal department, and labeled “California Customer Choice Notice.” Please allow 30 days for a response. Also, please note that there is no charge for controlling the sharing of your Personally Identifiable Information or requesting this notice.
  • 6. Cookies and Passively-Collected Information. As you use TrophyGolfer, certain information may also be passively collected and stored on our or our service providers’ server logs, including your Internet protocol (IP) address, browser type, and operating system. We also use session or persistent Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed, or on which of the advertisements displayed on TrophyGolfer you clicked. This type of information is collected to make TrophyGolfer and solutions more useful to you and to tailor the experience with TrophyGolfer to meet your special interests and needs. We may also enable advertisers and ad servers to promote third-party products and/or services by placing advertisements on TrophyGolfer. These advertisers and ad servers may use Cookies and/or "Web Beacons" (which are usually small, transparent graphic images) in order to monitor information related to served advertisements. Clicking on such advertisements will direct you to the website of a third-party and the advertiser. This Privacy Policy does not cover the privacy practices of any advertisers or ad servers.
  • 7. Use and Disclosure of Information. In general, Personal Information you submit to us is used by us to provide you access and a great TrophyGolf experience. Except as stated in this Privacy Policy, we will not sell, trade, rent, or otherwise share for marketing purposes the Personal Information that we collect with other parties except with the social network you may select and with the parties or in the situations described below:
    • a. TrophyGolfer Merchants. If you purchase a deal via TrophyGolfer, we will share some of your Personal Information with the Merchant, such as a Golf Course Operator, that offered the deal so you may redeem your purchase. We do not have any responsibility for the actions of the TrophyGolfer Merchant, the actions of the TrophyGolfer Merchant are not in our control, and we specifically disclaim any responsibility or liability for the actions of such TrophyGolfer Merchant.
    • b. Authorized Third Party Service Providers. We provide services and products through third parties. These “Third Party Service Providers” perform functions on our behalf. We may share your Personally Identifiable Information with such Service Providers to fulfill orders, send email, administer contests or sweepstakes, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the Website, troubleshoot, and provide customer service. We may also collect personal information from individuals and companies (“Affiliates”) with whom we have business relationships and may share your information with Service Providers to accomplish our administrative tasks. For example, when you order a service, we release your credit card information to the card-issuing bank to confirm payment for the service and may release an Affiliate’s information to our bank to send out a payment. However, the use of your Personal Information by such parties is governed by the privacy policies of such parties and is not subject to our control.
    • c. Remarketers. Remarketing is a way for us to connect with users, based upon your past interactions with the TrophyGolfer website. Third-party marketing vendors may be hired by TrophyGolfer to perform remarketing services. As a result, third-party vendors, including Google, may show TrophyGolfer ads on sites on the internet. Third-party vendors, including Google, use cookies to serve ads based on a user's prior visits to TrophyGolfer's website. Users may opt out of Google's use of cookies by visiting the Google advertising opt-out page at http://www.google.com/privacy_ads.html. This information is used only for remarketing purposes and will not be used by them for any other purpose.
    • d. Website Viewers. Certain information you post or provide through TrophyGolfer, such as your name, profile, comments, collections and reviews, may be shared with other users and posted on publicly available portions of TrophyGolfer, including without limitation, social media applications and other public fora in which you choose to participate. If you choose to disclose Personal Information when posting comments or other information or content through TrophyGolfer, this information may become publicly available and may be collected and used by others, including people outside the TrophyGolfer community. We will not have any obligations with respect to any information that you post to parts of TrophyGolfer available to others, and recommend that you use caution when giving out personal information to others through social media networks or otherwise.
    • e. Third Party Sites and Advertising. TrophyGolfer may contain links to other websites. Please be aware that we are not responsible for the privacy practices or the content of such other websites. We encourage our users to read the privacy statements of each and every website they visit. This Privacy Policy applies solely to information collected by us through TrophyGolfer and does not apply to these third-party websites. The ability to access information of third-parties from TrophyGolfer, or links to other websites or locations, is for your convenience and does not signify our endorsement of such third-parties, their products, their services, other websites, locations or their content.
    • f. Upon Business Transfer. If TrophyGolfer is acquired by or merged with another company, the successor company would acquire the Information we maintain, and may share it with companies under common control. However, such Information would remain subject to this Privacy Policy.
    • g. For our Protection and the Protection of Others. We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website; enforce or apply this Privacy Policy, our Website Terms of Use or other agreements; or protect the rights, property or safety of the Website, its Users or others.
    • h. Anonymous Statistical Gathering. Additionally, we may create Anonymous Information records from Personal Information by excluding information (such as your name) that would otherwise make the Anonymous Information personally identifiable to you. Generally, we aggregate this information and use it in statistical analysis to help us analyze patterns in the use of TrophyGolfer. This Privacy Policy does not limit our use or disclosure of any Anonymous Information in any way, and we reserve the right to use and disclose Anonymous Information to our partners, advertisers and other third parties in our discretion.
    • i. Feedback. If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy. You agree that any such comments and any email we receive becomes our property. We may use feedback for marketing purposes or to add to or modify our services without paying any royalties or other compensation to you.
  • 8. Your Choices Regarding Your Personal Information. We offer you choices regarding the collection, use, and sharing of your Personal Information. You have a right at any time to stop us from contacting you for marketing purposes. When you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the promotional e-mail you receive or by contacting us directly at Privacy@TrophyGolfer.com. Despite your indicated email marketing preferences, we may send you administrative emails regarding TrophyGolfer, including, for example, administrative and transactional confirmations, and notices of updates to our Privacy Policy if we choose to provide such notices to you in this manner. You have the right to request a copy of the Personal Information that we hold about you. If you would like a copy of some or all of your Personal Information, please contact us at help@TrophyGolfer.com. We may charge a reasonable fee for this service. We want to make sure that your information is accurate and up-to-date. You may ask us to correct or remove information which you think is inaccurate. You may change any of your profile information by editing it in the profile settings page.
  • 9. Security. We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. Even though we have taken significant steps to protect your Personal Information, no company, including us, can fully eliminate security risks associated with Personal Information.
  • 10. Account Deletion. Should you decide to delete your TrophyGolfer account, you may do so by contacting your local site administrator, or by clicking on the “delete your account” link on your account settings page. If you terminate your account, your profile, including any messages in your inbox and any promotional offers you received, will be removed from the site and deleted from TrophyGolfer’s servers. Because of the way we maintain TrophyGolfer such deletion may not be immediate, and residual copies of your profile information or posts may remain on backup media.
  • 11. Changes to our Privacy Policy. If we decide to change our privacy policy, we will post those changes on this page, email users, and/or update the Privacy Policy modification date below. This policy was last modified on April 22, 2011.
